Richard Berne, Esq. recently obtained complete dismissal of an action by motion to dismiss. Plaintiff alleged assault and unlawful restraint by defendants after they accused him of stealing proceeds from their commercial Halloween Party. Plaintiff served a Summons with Notice, and after receiving our demand for Complaint, failed to timely serve same. On motion to dismiss for failure to timely serve the Complaint, and despite opposition by plaintiff, the Hon. Linda Kevins dismissed the case in its entirety.
