In 2011, a tour bus hit a loose construction plate in front of what would become the Barclays Center in Brooklyn. A number of the passengers were thrown from their seats, and they sued individually and in different counties. Eventually, the case was consolidated in Kings Supreme Court. Our insured, Perfetto Contracting, had done work during the same timeframe, but their work ended approximately a mile from the location of the raised plate. We moved for summary judgment, which the Court granted, after years of delays.
