Motion to Dismiss Granted for Failure to Provide Discovery – Queens County

Kabir v. Richardson, (Queens Co. Sup. Ct. 2020). On September 23, 2020,  the Hon. Justice Richard G. Latin dismissed plaintiff’s claims pursuant to NY C.P.L.R. Section 3216.  In this motor vehicle action, plaintiff and defendant were operators of separate vehicles involved in an intersection accident.  Plaintiff claimed severe personal injuries.  Our law firm aggressively sought discovery sanctions and dismissal of plaintiff’s claims following his repeated failure to provide discovery and appear for court ordered depositions.  The Court, noting that this was our client’s second such motion and the repeated good faith efforts that were made to obtain the critical discovery, agreed to a full dismissal, with prejudice, of all of plaintiff’s claims.
